In Kenya access to Justice and the provision of Legal Aid Services to the indigent is guided under a regulatory framework comprising of the Constitution of Kenya 2010, various statutory instruments and guidelines issued by established bodies with special mandate on the provision of Legal Aid.
To regulate the provision of Legal Aid Services, the Legal Aid Act, 2016, was enacted. The enactment of the Legal Aid Act gave effect to the Article 19(2), 48, 50(2) (g), & (h) of the Constitution of Kenya 2010.
Further, the Legal Aid Act was meant to facilitate access to justice and social justice; establish the National Legal Aid Service (the NLAS) – to provide legal Aid; funding of legal Aid and for connected purposes.
Apart from the statutory body, NLAS, established under Legal Aid Act, there are other institutions that are available to offer legal aid services including pro bono services. FIDA – Kenya is an organization that champions for a society that respects and upholds Women’s rights guided by its Constitution – FIDA-Kenya Constitution. As an organization, FIDA-Kenya thus determines its own standards to apply to its members as well as all other partners it engages with in realization of its mandate and or aspirations. The code herein articulates principles, sets standards and provides guidance on the standards of professional practice and ethical conduct expected of the FIDA-Kenya external partners.
